Edwardsville homeowner alleges contractor abandoned job, damaged property

EDWARDSVILLE — An Edwardsville homeowner alleges the contractor he paid to remodel his home abandoned the job and damaged his property. 

James Timmer filed a complaint Nov. 10 in the Madison County Circuit Court against Castle AV Media Solutions LLC and Thomas J. Costello, alleging breach of contract, fraud and other claims. 

According to Timmer's complaint, he entered into a contract with the defendants on Feb. 10, 2020, to remodel the existing two-car garage into an apartment/living quarters at his home on Quercus Grove Road in Edwardsville. Timmer claims he agreed to pay $37,870 with an $18,000 down payment, which was paid in full by Jan. 19, 2020. 

Timmer claims the defendants assured him the project would take two to four weeks to complete. However, Timmer alleges that by August 2020, the defendants abandoned the job site without completion and left his property in disrepair, in a dangerous condition and "unsightly and unappealing." 

Timmer also claims the defendants impacted the natural landscape and topography of his property, failed to abide by the contract, and made false representations about the labor, services and materials in violation of the Illinois Consumer Fraud & Deceptive Business Practices Act. 

Timmer seeks compensation of more than $50,000, interest and all other just relief. He is represented by Bryan Dooling of MillerKing LLC in Alton.
