Contractor allegedly improperly built retaining wall, failed to complete project

EDWARDSVILLE — An Edwardsville property owner claims she paid more than $150,000 to a contractor to build a retaining wall that remains incomplete and improperly constructed. 

Marcia Billhartz filed a complaint Aug. 24 in the Madison County Circuit Court against Paul Crayne, doing business as Executive Lawn Care Services, alleging breach of contract, breach of implied warranty and fraud.

According to Billhartz's complaint, she entered into a contract with Executive Lawn in October 2020 for the construction of a 165 linear feet retaining wall on her property on Fox Crest in Edwardsville. She alleges she paid Executive Lawn $151,925. However, she alleges that after seven months, the construction of the wall is not close to being completed. Billhartz also claims the construction that has been done was out of grade, improperly located and improperly constructed for the load and weight it must support. She further alleges the wall of is "out of square," improperly designed and structurally unsound. Executive Lawn allegedly failed to use adequate support behind the wall. 

Billhartz claims she has had to pay additional funds to have the existing wall demolished and properly rebuilt. 

Billhartz seeks monetary and all other proper relief. She is represented by Joseph Harvath of Byron Carlson Petri & Kalb LLC in Edwardsville.
