Motorist sues truck driver over rear end crash on I-55

EDWARDSVILLE — A motorist claims a tractor trailer driver who rear ended his vehicle on I-55 was speeding and failed to have adequate brakes on the truck. 

Mark C. Lankford filed a complaint Aug. 3 in the Madison County Circuit Court against Ross A. Mortimer and Gary Mortimer Farms Inc., alleging negligence. 

According to the complaint, Lankford was driving his motor vehicle on I-55 in the Township of Hamel on Nov. 1, 2019. He alleges that Mortimer, who was driving a tractor trailer, failed to stop and caused a rear end collision. 

Lankford claims that as a result of the collision, he suffered injuries to his shoulder, back, soft tissues, muscles, ligaments, tendons and nerves. He also claims he lost wages and incurred medical expenses. 

Lankford alleges Mortimer was negligent for not keeping a proper lookout for other vehicles and for driving at an excessive speed. Lankford also alleges Mortimer was following his vehicle too closely and operated the tractor trailer without it being equipped with adequate brakes. 

Lankford seeks compensation of more than $50,000 and all other just relief. He is represented by John Hustava of Collinsville.
