EAST ST. LOUIS — A woman is suing a cancer treatment center and two of its physicians alleging her husband suffered from radiation necrosis and developed a tumor on his throat due to their negligent care.
Jennifer Lynn Lueken, on behalf of Richard Dennis "Rick" Lueken, filed a pro se complaint Aug. 4 in the U.S. District Court for the Southern District of Illinois against Crossroads Cancer Center, Michael Bruin, M.D., and Irene Dy, M.D., alleging fraud, wrongful death, medial malpractice and negligence.
According to Lueken's complaint, her husband Rick Lueken was being treated at Crossroads Cancer Center. She claims in her suit that in May 2012, Lueken's physician at Crossroads ordered a scan of his head and neck. The plaintiff alleges her husband's oncologist then left Crossroads in August 2012, and he came under the care of Dy.
She claims her husband later became dizzy and unbalanced and was found to have radiation necrosis on his brain as well as a tumor on his throat due to Bruin's prescribing too much radiation therapy. The plaintiff alleges Dy failed to have further scans done on her husband's head and neck at his follow-up visits. Then in June 2016, the plaintiff claims she and her husband were told that he had no cancer or masses despite a tumor being present on his throat.
Lueken seeks monetary relief of $5 million, plus trial by jury and all other just relief.
