EAST ST. LOUIS — A man claims his credit union debt was mistakenly reported twice, which has negatively impacted his credit report.
Kyle Fickel filed a complaint July 9 in the U.S. District Court for the Southern District of Illinois East St. Louis Division against Clearwater Credit Union, formerly known as Missoula Federal Credit Union, Northwest Collectors Inc., Experian Information Solutions Inc., Equiax Information Services LLC and Trans Union LLC, alleging violation of the Fair Credit Reporting Act.
Fickel alleges in his suit that he obtained credit from Missoula on Sept. 9, 2010, and incurred a $10,145 debt. He fell behind in payments in November 2017, and Northwest Collectors becoming the third-party collection agency for the debt. Fickel claims that in December 2019, he viewed his credit file through Experian, Equifax and Trans Union and discovered that they incorrectly showed his debt as being $22,000. He alleges both Northwest and Clearwater reported the collection account when only one entity or person should have reported the debt. He also claims that neither Experian nor Equifax invested his dispute of the debt reporting and that Northwest and Clearwater continued to report inaccurate information regarding his debt.
Fickel seeks monetary relief, trial by jury and all other just relief. He is represented by Youssef Hammound of The Price Law Group APC in Encino, Calif.
