EDWARDSVILLE — The estate of a woman who suffered a fatal brain injury in a rear-end collision is suing the other driver for allegedly driving while intoxicated.

Karol Hornberger, as independent Administrator of the Estate of Simone Lutz, deceased, filed a complaint  July 9 in the Madison County Circuit Court against Corey Tarrant, alleging wrongful death.

According to the complaint, Lutz was driving her vehicle on US-67 on June 13. The plaintiff claims Lutz was stopped for a red light when Tarrant crashed into the back of her vehicle and caused her to suffer serious injuries, including a traumatic brain injury that "ultimately" led to her death.

The plaintiff alleges Tarrant was negligent for speeding, driving while intoxicated, failing to reduce his vehicle's speed to avoid the collision and driving while distracted. The plaintiff also alleges Tarrant failed to keep a proper lookout or warn of the impending crash.

The plaintiff seeks compensation of more than $50,000 and all other just relief. She is represented by Michael Glisson and Timothy Chartrand of Williamson, Webster, Falb & Glisson in Alton.
