Suit alleges Mod Pizza violated BIPA with employee fingerprint scans

EAST ST. LOUIS — Mod Pizza is facing a class action alleging it violated the Illinois Biometric Information Privacy Act by requiring employees' fingerprint scans to punch in and out of work.  

Alyssa Marie Pratz, individually and on behalf of all others similarly situated filed a complaint June 30 in the U.S. District Court for the Southern District of Illinois East St. Louis Division against Mod Super Fast Pizza LLC, doing business as MOD Pizza, alleging violation of the Illinois Biometric Information Privacy Act. 

Pratz, who worked at Mod Pizza's Edwardsville location, alleges the company illegally collected employees' fingerprint scans through its timekeeping system. She claims the defendant never informed employees about the "specific purposes or length of time" their fingerprint scans would be collected and stored and failed to obtain proper authorization to collect and capture their biometric information. Pratz also claims the defendant did not publicly provide its employees with a biometric data retention policy or information about if their data will ever be permanently deleted. She further claims the defendant's actions exposed employees to "harms and risks" and violated their rights to privacy. 

Pratz seeks monetary relief, trial by jury and all other just relief. She is represented by Benjamin Whiting and Alex Dravillas of Keller Lenkner LLC in Chicago.
