Tenant claims Collinsville apartment building construction debris caused fall

EWARDSVILLE — A woman claims she fell from the stair landing at her Collinsville apartment complex due to construction and renovation work. 

Julie Jenkins filed a complaint June 25 in the Madison County Circuit Court against Stephen Tassallo, alleging negligence and premises liability. 

Jenkins claims she was at her apartment complex on July 1, 2019, located on East Main Street in Collinsville, which is owned and managed by the defendant. She alleges that as she attempted to use the stairs, she fell from the stair landing "with great force and violence" and suffered injuries to her back, arm, wrist and hand. 

Jenkins also alleges Tassallo was negligent for allowing "major repairs and modifications" to be done to the premises that were in excess of the city's building permit. She claims a stop work order was placed on the premises. She further alleges that the defendant allowed construction debris to remain in the common areas and stair landing and had authorized the workers to remove the stair railing during the repairs. Jenkins claims Tassallo was negligent for failing to provide a safe alternative method to enter or leave the property. 

Jenkins seeks monetary relief of more than $50,000 and all other just relief. She is represented by Bruce Mattea and William Boker, III of The Mattea Law Firm in Collinsville.
