Patient alleges hospital's negligence led to bone destruction

BENTON — A patient alleges physicians at HSHS Holy Family Hospital failed to properly treat and diagnosis her staph infection and worsening back pain, which allegedly spread and led to a bone infection. 

Cory Lynn Daul filed a complaint June 17 in the U.S. District Court for the Southern District of Illinois against HSHS Holy Family Hospital Inc., Asim Elmahboub, M.D., Andrew Mahtani, M.D., Jose Novof, M.D., Peter Kim, M.D., and Anthony Sodd, M.D., alleging negligence.

According to her complaint, Daul was an inpatient at HSHS Holy Family Hospital from June 2, 2019, through June 7, 2019, and was being treated by the defendants for back, abdominal, flank pain and a fever and was diagnosed with a staph infection. She claims that on June 17, she returned to HSHS with thoracic back pain and received no evaluation or treatment for her condition. She returned again on June 20, 2019, after she allegedly attempted suicide due to the "unbearable and unrelenting pain." 

Daul claims that for the next several weeks she continued to seek treatment at HSHS Holy Family Hospital. On July 8, 2019, further imaging reveled her osteomyelitis had progressed to bone destruction, an epidural abscess and spinal cord compression, the suit states. 

She alleges the defendants were negligent in failing to properly treat her staph infection, failed to diagnose her worsening back and abdominal pain, dismissed her complaints of severe pain and failed to obtain consultations from specialists for her treatment. 

Daul seeks compensation of more than $75,000 and all other just relief. She is represented by Timothy McArdle of the Nolan Law Group in Chicago and attorneys with Hassakis & Hassakis PC in Mount Vernon.
