Class action alleges Kroger-brand coffee canister is misleading

EDWARDSVILLE — Kroger is facing a class action alleging it "grossly overstates" the amount of coffee that can be made from one of its ground coffee canisters. 

Anthony Womick, individually and on behalf of all other similarly situated, filed a complaint May 12 in the Madison County Circuit Court against The Kroger Co., alleging violation of the Illinois Consumer Fraud and Deceptive Business Practice Act and unjust enrichment.

Womick alleges in the class action that Kroger is deceiving consumers by misrepresenting the number of cups of coffee that can be made from its canister of Kroger-brand ground coffee.   He specifically alleges that each canister label "represents that the contents are sufficient to make a certain number of cups." However, he alleges that if consumers follow the directions on the coffee canister, the "contents are insufficient" to make the 235 cups stated on the canister. Womick alleges the contents in the canister will make 173 cups if the measurements on the directions are used. He claims the instructions "leaves the consumer significantly short."  

Womick seeks monetary relief, interest, trial by jury and all other proper relief.
