Belleville property owners allege sediment from adjacent property damaged land, pond

BELLEVILLE — A Belleville couple claims their property has been damaged by adjacent property owners who allowed sediment to drain onto their land.

Timothy James Deppe and Sandra Lynn Deppe filed a complaint April 27 in the St. Clair County Circuit Court against Hank's Excavating & Landscaping Inc., Steven L. Lidisky and Kelli A. Lidisky, alleging trespass, nuisance, negligence and other claims. 

According to their complaint, the Deppes own property on Llewellyn Road in Belleville that is adjacent to land owned by the Lidiskys. The plaintiffs allege that Hank's Excavating "created a large pile of silt" that had been removed from the Lidiskys' pond. Then in July 2019, the Lidiskys allegedly hired a farmer to develop "a retention/remediation system" to prevent further silt from going onto their property.

The Deppes also allege that a contractor ran a pipe from the Lidiskys' land to their pond as a "temporary remediation system." However, the work was "inadequate" and caused "large amounts" of silt to come off of the Lidiskys land, onto their land and into their pond. The Deppes claim they have had to remove the pipe and dredge their pond so that it could return "to their natural water course." 

The Deppes seek monetary relief, trial by jury and all other just relief. They are represented by James DeFranco and Nicholas Martin of DeFranco & Bradley PC in Fairview Heights.
