Construction worker alleges OSHA violations resulted in fall off ladder

EDWARDSVILLE — A construction worker who fell off a ladder at a job site in Bethalto claims OSHA regulations were not followed at the project site. 

Saul Antonio Garcia Alvarenga filed a complaint April 21 in the Madison County Circuit Court against KH Properties LLC, KH Properties Illinois LLC and Metro Apartments of Bethalto LLC, alleging negligence and premises liability. 

According to the complaint, the plaintiff was employed by Granados Construction and was working at a job site on Rue Sans Souci in Bethalto on Jan. 17, 2020. The suit states that KH Properties was the general contractor for the project. Alvarenga alleges he fell from a ladder and suffered "severe and permanent" injuries. 

The plaintiff claims the defendants were negligent for failing to provide "suitable and proper" scaffolding or support and for failing to have proper fall protection for workers on the site. He further claims the defendants were negligent for failing to follow and enforce OHSA rules and regulations. The defendant is also accused of failing to "properly grade the job site," which caused workers to have to place ladders on "unsafe, unstable and uneven loose ground."

The plaintiff seeks monetary and all other just relief. He is represented by Robert Adelman of Levin, Riback & Adelman PC in Chicago.
