BELLEVILLE — Current and former Oldcastle employees have filed a proposed class action alleging the company violated the Illinois Biometric Information Privacy Act (BIPA) by requiring fingerprint scans without consent.
Jermaine Minor, on behalf of himself and other persons similarly situated, filed a complaint April 16 in the St. Clair County Circuit Court against Oldcastle Services Inc., alleging violation of BIPA.
Minor claims in the proposed class action that he and other present and past employees of Oldcastle were subject to "unlawful biometric scanning and storage practices" because the defendant required the use of worker's fingerprint scans to clock-in and clock-out of work.
Minor alleges Oldcastle failed to notify employees where their fingerprints are being stored, the duration their information would be stored and "what might happen to this valuable information." He further claims Oldcastle did not comply with BIPA by failing to obtain employees' written consent to capture their biometric data and failing to inform employees how their data would be secured and how it will be "handled and destroyed."
Minor seeks monetary and all other just relief. He is represented by Roberto Costales and William Beaumont of Beaumont Costales LLC in Chicago.
