BELLEVILLE — A motorist claims her vehicle's restraint system was defective during a "low speed" collision, requiring one of her eyes to be removed as a result of her injuries.
Kimiya Ross filed a complaint March 19 in the St. Clair County Circuit Court against Ford Motor Company, ZF TRW Automotive Holdings Corp., and Ronald McComb, alleging negligence.
According to her complaint, Ross was driving her 2015 Ford Focus on Illinois Route 3 on June 14, 2020, when she collided "at a low speed" with a vehicle driven by McComb. She alleges that even though the collision was "low speed," her Ford's restraint system malfunctioned, causing "explosive deployment" of her car's airbag. Ross also alleges her vehicle's seatbelt did not "properly restrain" her and caused her to suffer an eye orbital fracture, lacerations on her eyelids and the rupture of the globe in one of her eyes which had to be removed. She claims the restraint system designed by the defendants was defectively designed and contaminated with "foreign objects that became projectiles."
Ross also claims the defendants failed to warn about the "correct seat position during use" which "represented a hazard."
Ross seeks compensation of more than $50,000 and all other just relief. She is represented by Bruce Cook of Cook, Bartholomew, Shelvin, Cook & Jones LLP in Belleville.
