Suit alleges union workers were denied contracted pay contributions

EAST ST. LOUIS — The Central Laborers' Pension Welfare and Annuity Funds claims union workers hired for various construction projects have been denied pay contributions. 

Central Laborers' Pension Welfare and Annuity Funds filed a complaint March 17 in the U.S. District Court for the Southern District of Illinois against Joseph F. Becker Inc., and John Becker, alleging violation of the Employee Retirement Income Security Act.

According to their complaint, the plaintiffs are various "pension, welfare and related joint-labor management funds." They allege in their suit that "an authorized representative" of Joseph Becker Inc., entered into a agreement with their respective unions in August 2000, August 2008 and December 2008, which requires the defendants to pay contributions to the plaintiffs. 

The plaintiffs claim that an audit of payroll records from Jan. 1, 2013, through Sept. 30, 2018, shows the defendants have failed to make payment contributions, liquidated damages of more than $15,000 and have been "delinquent" in reporting the hours worked by their employees. 

The plaintiffs seek monetary and all other just relief. They are represented by. Thomas Kelley of Kelley & Kelley LLC in Belleville.
