Employees allege Crescent Park Corporation violated BIPA

EDWARDSVILLE – A man claims his biometric information was stored without his consent in a class action against his employer, Crescent Park Corporation.

Jeff Ballesteros, individually and on behalf of all others similarly situated, filed a complaint March 11 in the Madison County Circuit Court against Crescent Park Corporation, alleging violation of the Illinois Biometric Information Privacy Act. 

Ballesteros alleges in his complain that while employed by Crescent Park Corporation, he was required to use a scan of his face to clock in and out of work using the company's time clock. He claims his face was scanned "multiple times" so that the defendants could "create, collect, capture, construct, store and use his "biometric template" for identification and authentication. Ballesteros alleges he was never informed about the specific purpose or amount of time his biometric data would be collected and stored or whether his data will eventually be permanently deleted. He also alleges he never gave permission for his biometric data to be captured, collected and stored and that he and other employees have been exposed to risks. 

Ballesteros claims Crescent Park's actions are in violation of the Illinois Biometric Information Privacy Act. 

Ballesteros seeks monetary and all other just relief. He and the putative class are represented by Brandon Wise and Paul Lesko of Peiffer Wolf Carr & Kane APLC in St. Louis.
