Wrongful death suit alleges mine worker died after being struck by steel pipe

EDWARSVILLE — The estate of a mine worker who died after being struck by a steel pipe is suing his employer for wrongful death.

Tyler Corbin, as special administrator of the Estate of John Corbin, deceased, filed a complaint Feb. 8 in the Third Judicial Circuit Court for Madison County against Fred Weber Inc., and Bluff City Minerals LLC, alleging wrongful death.

According to the complaint, John Corbin was working for Bluff City on May 21, 2020, and was helping to remove and replace a motor on a conveyor in a mine with a lever hoist and one-ton chain hoist. The plaintiff claims that an 11 foot steel pipe positioned between two beams that was left unsecured, shifted and struck John Corbin. The pipe allegedly struck him on the head and back, knocking him to the ground. The plaintiff claims that John Corbin died of his injuries on May 23, 2020.

Tyler Corbin alleges the defendants were negligent in failing to properly train the workers, failing to supervise the workers, and failing to warn of the hazard and dangers involved in the project, particularly the danger of an unsecured steel pipe "placed on the flanges of I-beams." The plaintiff alleges that the defendants also failed to provide proper equipment or inspect the set up of the project. 

The plaintiff seeks compensation of more than $50,000 and all other just relief. He is represented by Benjamin Tobin and Edward Szewczyk of Pratt & Tobin PC in East Alton.
