Woman sues East Alton over alleged trip, fall on sidewalk

Lawsuits

EDWARSVILLE — The Village of East Alton is facing a suit from a woman alleging she tripped on a broken sidewalk and suffered injuries.

Joyce Smith filed a complaint Jan. 29 in the Madison County Circuit Court against the Village of East Alton.

According to her complaint, Smith was walking north on Victory Drive in East Alton on March 17, 2020. She alleges she was "caused to slip, trip, stumble and/or fall" on a "broken and defective" sidewalk and suffered "severe and permanent" injuries to her knee that required medical treatment and surgery.

Smith alleges she has been hindered from "attending to her normal affairs" and has incurred medical expenses as a result of the fall.

Smith claims East Alton failed to maintain, inspect or make repairs to the sidewalk and also failed to barricade the sidewalk or warn of the defective condition of the sidewalk. Smith alleges East Alton "knew or through the exercise of reasonable care" should have known of the dangerous condition of the sidewalk.

Smith seeks monetary relief of more than $50,000 and all other just relief. She is represented by Jacqueline Cichon of Polansky & Cichon CHTD in Chicago.
