Suit alleges debt collector failed to identify creditor in correspondence

Federal Court

EAST ST. LOUIS — A woman claims a debt collection company failed to supply the required information in its collection correspondence.

Angela Brandmeyer filed a complaint Jan. 22 in the U.S. District Court for the Southern District of Illinois East St. Louis Division against Lloyd & McDaniel PLC, alleging violation of the Fair Debt Collection Act.

Brandmeyer alleges in her complaint that after defaulting on her payments to Synchrony Bank due to suffering financial hardship, the defendant violated the Fair Debt Collection Act in its efforts to collect on her debt. Specifically, Brandmeyer alleges that she received a letter from the defendant which did not "conspicuously identify the current creditor" and requested direct payment be made to Lloyd & McDaniel. She claims the defendant's correspondence was confusing and leaving her unable to determine who was the current creditor and to whom she owed the debt.

Brandmeyer also claims that the confusion resulted in her not being able to pay and has "raised the risk of imminent adverse credit reporting" regarding her debt.

Brandymeyer seeks monetary and all other just relief. She is represented by Alexander Taylor of The Sulaiman Law Group LTD in Lombard.
