BELLEVILLE — A man is suing Apple and others alleging his iPhone 6 caught on fire while in his pocket.
Ketric Giles filed a complaint Dec. 11 in the St. Clair County Circuit Court against Apple Inc., Phone Pandora Inc., and DISH Network LLC, alleging breach of warranty, strict liability and negligence.
Giles purchased an iPhone 6 from Boost Mobile in Fairview Heights, according to his suit. He alleges that on Dec. 14, 2018, the iPhone was inside the hip pocket of his pants when it caught on fire and caused him to suffer burns to his hip, thigh and pubic area.
Giles claims he was using the iPhone "for the purpose and use normally intended," but the phone was defective and malfunctioned causing it to catch fire. He further claims the phone's alleged defect was caused by "no fault or carelessness of his own" and that the defendants breached the product's warranties and "merchantability and fitness for intended use."
He also claims the defendants were negligent in manufacturing, producing and selling the product.
Giles seeks compensation of more than $50,000, interest and all other proper relief. He is represented by J. Brad Wilmoth of Page Law LLC in St. Louis.
