Man allegedly suffered sexual harassment, discrimination while working at Troy restaurant

EDWARDSVILLE — A former employee of a Troy pizza restaurant claims he faced sexual harassment and discrimination while working for the defendant. 

Joseph Brittin filed a complaint Nov. 24 in the Madison County Circuit Court against McMahan Inc., doing business as Joe's Pizza & Pasta, alleging violation of the Civil Rights Act of 1964 and Title VII of Civil Rights Act of 1991.

Brittin was employed at Joe's Pizza & Pasta in Troy, according to his complaint. He alleges that while working for the defendant, he was subject to "continued sexual harassment, a hostile work environment and discrimination" by his supervisors and coworkers. Specifically, Brittin claims he faced "inappropriate sexual comments" and "uninvited and unwanted" touching, as well as humiliation. He also alleges that his "similarly situated" female coworkers were treated "more favorably." 

Brittin further claims Joe's Pizza & Pasta failed to "take reasonable steps" to investigate and prevent the alleged sexual harassment, discrimination and hostile work environment. He claims that on Aug. 9, 2019 he was "constructively discharged." 

Brittin received a right to sue from the Equal Employment Opportunity Commission on Aug. 28, 2020. 

Birttin seeks compensation of more than $50,000 and all other just relief. He is represented by Michael Brunton and Mary Stewart of The Bruton Law Office PC in Collinsville.
