Woman alleges she broke her leg after tripping over band stage at Smithton pub

BELLEVILLE — A woman is suing a Smithton pub and restaurant alleging her chair was placed too close to the band stage, which caused her to trip, fall and suffer injuries. 

Diane Stoneking filed a complaint Nov. 12 in the St. Clair County Circuit Court against S&M Pilla LLC, doing business as Mikey's Pub, alleging negligence. 

Stoneking alleges in her complaint that she was eating lunch at Mikey's Pub on South Main Street in Smithton on Oct. 4, 2019. During lunch, she claims she tripped and fell over the band stage when she attempted to get out of her chair.  Stoneking claims she suffered a broken leg and other injuries as a result of her fall. 

In her suit, Stoneking alleges Mikey's Pub negligently placed a table and chair "directly in front of the band stage" where someone getting out of the chair "would not recognize the band stage was a trip hazard." She also alleges Mikey's Pub was negligent for failing to warn about the band stage and trip hazard and failing to "exercise reasonable care in the maintenance of their premises."

Stoneking seeks compensation of more than $50,000 and all other proper relief. She is represented by attorney Matthew Young in Belleville.
