Lawsuits

BELLEVILLE — A shopper claims the basket on an Aldi Supermarket wheelchair cart fell off, causing the plaintiff to suffer injuries.

Connie Kenny filed a complaint Sept. 28 in the St. Clair County Circuit Court against Aldi Inc., alleging negligence.

According to his complaint, Kenny was shopping at the Aldi Supermarket on Kirk Road in Batavia on July, 5, 2019. The plaintiff alleges that while trying to use one of the stores "wheelchair grocery" carts, the basket fell off the cart and caused her to suffer injuries.

Kenny allegedly suffered pain, anxiety and incurred medical expenses as a result of the alleged incident. Kenny also claims she will continue to suffer "losses and impairment in the future."

Kenny alleges Aldi "negligently and carelessly" purchased the cart as well as negligently maintained and inspected the wheelchair cart that was in the store. The plaintiff claims the cart was "dangerous and unsafe for intended users."

Kenny seeks monetary compensation of more than $50,000 and all other just relief. She is represented by John Hipskind and Brady McAninch in Belleville.
