BELLEVILLE – A motorist claims a semi-truck driver was texting when he crashed into the back of his vehicle.
Stanley Swisher filed a complaint Sept. 28 in the St. Clair County Circuit Court against Edmund Archambeault and Shipex Carrier Services LLC, alleging negligence.
According to the complaint, Swisher was driving a 2004 Chevy Silverado on I-57 on March 1, 2019. He alleges that due to a traffic collision and delay on the highway that had formed, he had to slow down. Swisher claims that Archambeault, who was driving a tractor trailer owned by Shipex, "suddenly and without warning" crashed into the back of his car and caused him to suffer "severe personal injuries." As a result, Swisher had to receive a police escort to a nearby hospital.
Swisher claims Archambeault was negligent by failing to maintain control of the tractor trailer, driving while texting or using other "personal messaging systems," and recklessly operating the vehicle. He also alleges Archambeault was not complying with "applicable state and/or federal regulations" for operating a semi-truck.
Swisher also alleges Shipex was negligent and liable for Archambeault's alleged actions that took place while he was acting "within the scope and course of his employment."
Swisher seeks monetary relief of more than $50,000, trial by jury and all other proper relief. He is represented by John G. Simon and John M. Simon of The Simon Law Firm PC in St. Louis.
