BELLEVILLE — A woman is suing an auto body repair garage after an employee allegedly lowered a car lift onto her foot.
Renee Rogers-Roberson filed a complaint Oct. 1 in the St. Clair County Circuit Court against M&M Auto Service II LLC, alleging negligence.
According to her complaint, the plaintiff alleges she brought her car to M&M Auto Service on Aug. 2, 2019, to have some tires and rims replaced on her vehicle. She claims that when one of M&M's employees called her to come over to the repair bay in the garage, another employee began to lower the car lift onto her foot.
The plaintiff states in her suit that she suffered "extensive injuries" that resulted in disability and disfigurement and caused her loss of a normal life, including lost wages and future lost earnings. She also claims her injuries have caused her to suffer "mental anguish" and to incur medical treatment costs, such as physician, hospital and pharmaceutical expenses.
The plaintiff alleges M&M negligently failed to mark any kind of "boundaries" to mark where the car lift would be on the floor and failed to require the employee to "verbalize a warning" to her as she was close to the lift or to confirm that it was safe to lower the lift. She also claims M&M knew or should have known of the "unreasonable risk of harm" the lift would cause to its customers who were inside the garage picking up their cars.
The plaintiff seeks monetary compensation or more than $50,000 and all other just relief. She is represented by Matthew Marlen of Matthew J. Marlen PC in Belleville.
