EDWARDSVILLE – The owners of a Granite City performing arts center are being sued for alleging breaching a sales contract by failing to make payments on the property.
Robert and Lorie Stoppkotte filed a complaint Sept. 22 in the Madison County Circuit Court against We Live Performing Arts Center Inc., and Joanha Moore, also known as Jahna Witener, individually and as owner, claiming breach of contract.
The Stoppkottes, who are residents of Madison County, state in their complaint that they entered into a contract on March 28, 2019, to sell their business on Cleveland Avenue in Granite City to the defendants. They claim that under the contract, the defendants were required to pay them $66,000 over 48 months with monthly installments of $1,519.93.
The Stoppkottes allege that to date, they have not received any of the payments they are due according to the purchase agreement. They also state in the complaint that the contract allows for "late fees and penalties" if the installments are not "paid in a timely manner." The Stoppkottes also allege that the defendants have breached the sales contract by not insuring the property and failed to name them as "additional named insureds," per the sales contract.
The Stoppkottes seek monetary relief of more than $50,000 and all other proper relief. They are represented by Eric Evans of Evans/Blasi in Granite City.
