Architects sued over alleged apartment design flaws, flooding issues

BELLEVILLE —  A Shiloh apartment center claims architectural design flaws resulted in flooding issues, which cost more than $288,000 in repairs. 

Greenmount Retail Center L.L.C. filed a complaint Sep. 1 in the St. Clair County Circuit Court against Hurford Architects, Inc., alleging negligence and breach of contract.

According to their complaint, Greenmount hired Hurford Architects to design an apartment complex in Shiloh. The plaintiff also hired a general contractor to build the apartment complex based on Hurford's designs. Greenmount alleges that after the complex was built, occupants reported water leakage on about June 21, 2019. Greenmount also alleges that inspections found “multiple design defects" that caused rain water to accumulate in breezeways and flow down from one floor to another.  

Specifically, Greenmount claims the design defects caused the water damage and did not provide proper protection from rain coming into breezeways. Greenmount alleges the design consisted of an inadequate roof, inadequate breezeway overhangs,  no slope on the ground floor concrete and no slope against exterior walls of ground floor apartment units. 

Greenmount alleges it lost rental revenue due to the alleged design flaws.

Greenmount seeks more than $50,000 and all other just relief. It is represented by Justin Welply and Christopher Miller of SmithAmundsen LLC in Saint Loius.
