Shopper claims ‘baby oil’ substance on floor at Marshalls caused her to slip, fall

BELLEVILLE — A shopper claims she was injured when she slipped and fell on a "baby oil like substance" at the Fairview Heights Marshalls store. 

Eleanor Vaughan filed a complaint Aug. 13 in the St. Clair County Circuit Court against T.J. Maxx Companies Inc., alleging negligence. 

According to her complaint, Vaughan was at the defendant's Marshalls store in Fairview Heights on Aug. 18, 2019. She alleges that as she entered the store, she slipped, stumbled, lost her balance and fell on a "baby oil like substance/or liquid" that had accumulated on the floor. 

Vaughan claims she suffered "severe and permanent" injuries including disfigurement. Along with pain and suffering, Vaughan also claims she has incurred medical bills due to the treatment of her injuries. 

She alleges in her suit that the defendant was negligent for failing to "maintain the floors of the premises in a safe condition" and failing to warn shoppers of the wet floor. She also claims the defendant failed to put out barricades or other devices to prevent customers from entering the hazardous area. 

Vaughan seeks monetary relief of more than $50,000 and all other just relief. She is represented by Ellen Burford of The Burford Law Office in Granite City.
