Woman sues Caseyville homeowners after allegedly falling on sump pump discharge

BELLEVILLE —A woman is suing Caseyville homeowners after she allegedly slipped and fell on discharge from a sump pump that accumulated on the sidewalk in front of their residence. 

Sherry Brennan filed a complaint Aug. 17 in the St. Clair County Circuit Court against Ernie and Johanna Huse, alleging negligence. 

According to the complaint, Brennan alleges that on May 14, 2019, she was walking by the Huse's two residences on Far Oaks Drive in Caseyville. She claims she was walking on a "public walkway" on a "clear, sunny and dry" day. While walking, Brennan claims she slipped and fell on "discolored slime" that came from the discharge of a sump pump and accumulated on the sidewalk. 

As a result, Brennan claims she suffered severe "permanent" injuries to several parts of her body and nervous system, which is now "impaired." Brennan also claims as a result of the fall, she has undergone "extensive" medical treatment including "internal fixation" and insertion of a metal plate with nine screws, which has caused her to incur medical expenses. 

Brennan alleges in her complaint that the defendants negligently installed a pump that discharged onto a public walkway, failed to warn of the hazardous condition and allowed the discharged to stay on the public walkaway. 

Brennan seeks monetary relief of more than $50,000 and all other just relief. She is represented by Robert Nelson of Nelson & Nelson Attorneys At Law PC in Belleville.
