Passenger alleges injuries after driver attempted to pass waste truck, caused collision

BELLEVILLE — A vehicle passenger claims she was injured in a crash when the driver attempted to go around a waste truck. 

Pamela Berry filed a complaint Aug. 5 in the St. Clair County Circuit Court against Montez Miller, Aspen Waste Systems of Missouri Inc., the Village of Cahokia and Leslie Grice, alleging negligence. 

According to her complaint, Berry was a passenger in a vehicle owned and operated by Grice on Aug. 22, 2019. Grice was driving a 2017 Ford Focus on Maynor Drive in the Cahokia when she attempted to go around Miller, who was driving a waste truck. Berry alleges Miller began to move forward as Grice drove around the truck and caused a collision. 

Berry claims that as a result of the crash, she suffered injuries to her back and hip and has incurred expenses for medical treatment of her injuries. She also claims she has suffered "mental anguish" and loss of her normal life. 

Berry alleges Miller failed to keep a proper look out, was distracted while driving and drove at an unsafe speed. She alleges that Grice improperly passed and changed lanes while trying to go around the waste truck and failed to slow down or maneuver to avoid the collision. 

Berry seeks monetary relief of more than $50,000 and all other just relief. She is represented by Michael Glisson and Timothy Chartrand of Williamson, Webster, Falb & Glisson in Alton.
