Suit alleges Edwardsville Red Robin in default of lease agreement

EDWARDSVILLE — The Edwardsville Red Robin is facing a suit alleging it remains in default of its lease agreement despite receiving multiple notices from its landlord. 

Caplaco Thirty-Four Inc. and Dierbergs Edwardsville LLC filed a complaint July 23 in the Madison County Circuit Court against Red Robin International Inc., alleging breach of lease agreement. 

According to the complaint, Red Robin entered into a lease agreement with the plaintiffs in March 2006 to rent space in the Edwardsville Crossing Shopping Center. The plaintiffs allege that Red Robin has "defaulted in performance of the lease" by not paying rent, "including additional rent as described in the lease." The plaintiffs claim that a notice of default was sent to Red Robbin on May 22 and that Red Robin has failed to comply with the demand to remedy the default. 

The plaintiffs also allege that Red Robin was sent a written notice on July 15, allowing the restaurant five days to make payment or their "right to possession would be terminated." 

The plaintiffs claim that despite the notices, Red Robin remains in breach of their lease agreement and has failed to pay their rent. 

The plaintiffs seek monetary relief of more than $50,000, plus interest and all other proper relief. They are represented by Mark Goldenberg and Kevin Green of Goldenberg Heller & Antognoli PC in Edwardsville.
