EDWARDSVILLE -- A southwestern Illinois sports complex has been named in a premises liability lawsuit.
Madison County resident Juan Romero filed suit Sept. 9 in Madison County Circuit Court against The Field Sports Complex LLC, Jose Delgato, and Mercedes Delgato, doing business as The Field Sports Complex, alleging negligence.
In the original petition, Romero, who competed in a recreational sports league at the defendants’ facility in Pontoon Beach, alleged he sustained injuries from “a sheet of tempered glass and/or other such similar material acting as a barrier and/or wall” at one of the property’s soccer fields.
“As a direct and proximate cause of one or more negligent acts and/or omissions committed by the defendants, individually and acting by and through the employees, agents, and/or servants, the plaintiff made contact with the dangerous condition in question … and said the dangerous condition shattered upon contact, resulting in several lacerations to the plaintiff’s arm and body,” the suit said.
According to Romero, the lacerations required 40 stitches. He accuses the defendants of presenting “an unreasonable risk to the people lawfully on the premises,” including himself. The defendants allegedly neglected to prevent the subject incident.
“The plaintiff did not misuse the premises in any way, and was using the premises for its intended purpose,” the complaint said.
Romero seeks at least $50,000 in damages plus costs of court. He is represented by attorneys Michael P. Glisson and Taylor N. Fehrenz of Alton, Webster, Falb & Glisson in Alton.
