Shopper alleges injuries from slip, fall at Dollar General

Lawsuits

A woman who claims she slipped and injured herself on a wet floor at a mall in Granite City is accusing both the center and the store for allegedly allowing the dangerous conditions to exist.

Angela Agles-Kempfer filed suit in Madison County Circuit Court against the Bellemore Village Center and Dollar General.

Agles-Kempfer claims water on the floor of the Dollar General was a hazard, which caused her to fall and slip in June 2017.

Dollar General, which is headquartered in Goodlettesville, Tenn., did not immediately reply to a request for comment from the Record.

Agles-Kempfer, a resident of Madison County, claims that "for a long period...a section of the floor was covered with water, creating a slipping hazard for those walking on the floor."

She claims both the Bellemore center, on the Nameoki Road, and the owners of the Dollar General "owed a duty of care" to the plaintiff and other shoppers.

The defendants "allowed dangerous conditions to exist on the premises," failed to maintain the floor in a reasonably safe condition, did not erect a barrier and did not give adequate warning to customers, including the plaintiff.

Agles-Kemfer claims she suffered "severe injury" both internally and externally.

"She has in the past and will in the future continue to suffer pain and anguish," the complaint states.

"She has expended and will continue to expend sums of money for certain doctor, hospital, medical, and pharmaceutical expenses," it continues.

The plaintiff further claims she has lost wages due to her injuries and that her future earnings will be impacted.

Agles-Kempfer is seeking more than $50,000 in damages. She is represented by Micah Summers of Walton Telkin in Edwardsville.
