Client alleges insurer failed to provide proper compensation after car crash

BELLEVILLE — A client is suing his insurance provider, alleging he has not been properly compensated following a car crash.

Wayne Shmittling filed a complaint June 6 in St. Clair County Circuit Court against American Family, alleging breach of contract.

The suit states Schmittling was driving a 2013 Ford F-150 on Feb. 17, 2018, on state Route 161 in Mascoutah Township. The plaintiff claims his vehicle was involved in a crash with a 2007 Ford Escort driven by Sakura Spiller, who was allegedly driving recklessly. 

The plaintiff alleges he sustained numerous damages far in excess of the $25,000 limit contained by the owner of the reckless driver's car. The plaintiff claims he has sought coverage for the damages but American Family has failed to pay his policy claim requests.

Schmittling seeks attorney fees, an additional $60,000, all costs, and all further equitable relief. He is represented by attorney Jason B. Going of Belleville.
