BELLEVILLE —A man is suing a health services facility after a resident allegedly died after suffering from sepsis and decubitus ulcers.
George Rushing, as special administrator of the estate of Catherine Rushing, filed a complaint on May 9 in St. Clair County Circuit Court against Bria Health Services LLC, Belleville Healthcare & Rehabilitation Center Inc., doing business as Bria Health Services, Helia Healthcare Services LLC, doing business as Willow Creek Rehabilitation & Nursing Center, Helia Healthcare of Belleville LLC, doing business as Willow Creek Rehabilitation & Nursing Center LLC. The suit alleges negligence, violation of the Nursing Home Care Act, and wrongful death.
According to the complaint, Catherine Rushing was a resident at the defendants' facility beginning on April 30, 2017. She was admitted to the facility with a diagnosis of decreased memory, anxiety and depression. She was non-ambulatory and required supervision due to her medical conditions, the suit states.
Catherine Rushing was transported to Memorial Hospital on May 11, 2017. She was allegedly suffering from sepsis and decubitus ulcers, which developed or worsened while she was a resident at the defendants' facility, the suit states. Catherine Rushing's injuries allegedly caused her death.
George Rushing claims Catherine Rushing was not given the care that she required while at the defendants' facility, causing her to suffer from a number of health complications.
The plaintiff claims Catherine Rushing accumulated large bills while at the defendants' facility , suffered pain, emotional distress, and mental anguish.
The plaintiff is seeking relief in excess of $50,000, plus attorneys’ fees and court costs. The plaintiff is represented by Colleen C. Jones, Leah A. Captain of Cook, Bartholomew, Shevlin, Cook & Jones LLP in Belleville.
