Four Paws Veterinary Hospital co-owner accused of breaching contract

BELLEVILLE — An O'Fallon veterinarian and veterinary hospital are suing one of its co-owners for allegedly breaching a contract by applying for a zoning change. 

Four Paws Veterinary Hospital Inc. and Dr. James L. Jessen filed a complaint on May 10 in St. Clair County Circuit Court against Dr. James W. Bollimeier, alleging breach of contract.

According to the complaint, Jessen and Bollimeir each owned 50 percent of the Four Paws Veterinary Hospital. The suit alleges Bollimeier executed an employment contract with Jessen on Jan. 1, 2006, and later purchased a property at 706-800 East Highway 50 in O'Fallon.

The plaintiff alleges the defendant then applied for a zoning change from Advanced Medical Center LLC, which was owned and controlled by Bollimeier to operate a veterinarian office. The defendant allegedly filed a report that was a sound study in regards to the impact that would take place from a potential relocation of the veterinarian hospital, which was in violation of the contract signed by the defendant.

Jessen seeks damages in excess of $50,000, $1 million in punitive damages, and all other equitable and just relief. He is represented by attorney Robert J. Sprague of Sprague and Urband in Belleville.
