Mail carrier alleges dog owner failed to control pet

EDWARDSVILLE — A mail carrier is suing a Collinsville dog owner, alleging he fell after being attacked by the defendant's pet.

Terrell L. Spikes filed a complaint April 3 in Madison County Circuit Court against Savannah Potter and Jeff Kypta, alleging negligence.

The suit states that on May 22, 2017, Spikes was making mail deliveries in Collinsville when he was attacked by Potter's' Siberian huskie in a yard located on E. Main St. The property is allegedly owned by Kypta. The suit states Spikes was caused to fall, leading to severe, extensive and permanent injuries that require large sums of medical expenses.

The plaintiff alleges the defendant knew the dog previously had charged and attacked other people and that Potter released the dog without restraint when the plaintiff was in the yard.

Spikes seeks more than $50,000 in damages from both defendants, plus costs of suit. He is represented by attorney Randal R. Steele of Steele Law Offices LLC in Glen Carbon.
