Suit alleges man died after falling from restaurant's deck

EDWARDSVILLE — A relative is suing a Worden café alleging the eatery's negligence caused a man to fall from a deck, resulting in his death.

June Hayes, as special administrator of the estate of Tommy Hayes, deceased, filed a complaint April 1 in Madison County Circuit Court against Bnschrieber Inc., doing business as Yellow Dog Café & Bar, alleging wrongful death.

The suit states Tommy Hayes was at Yellow Dog as a customer April 9, 2017. Hayes allegedly fell from a deck at the restaurant and was seriously injured. His injuries led to his death on April 20, 2017, the suit states.

The plaintiff alleges Yellow Dog negligently failed to provide a proper hand railings on the deck and failed to properly inspect the premises.

June Hayes seeks monetary damages in excess of $50,000, as well as court costs. The plaintiff is represented by Leah A. Captain of Cook, Bartholomew, Shevlin, Cook & Jones LLP in Belleville.
