Man alleges biometric information saved without consent

EDWARDSVILLE —An employee has filed a class action lawsuit against an Elmwood company, alleging his biometric information was saved without his consent.

Robert Maricle, individually and on behalf of all others similarly situated, filed a complaint April 3 in Madison County Circuit Court against Agreliant Genetics LLC, alleging violation of the Biometric Information Privacy Act.

According to the complaint, Maricle is an employee of Agreliant Genetics and was required to clock in and out using his fingerprint. The plaintiff alleges he was unaware that the defendant was storing his biometric data and that the defendant's saving of this information is in direct violation of the Biometric Information Privacy Act.

The suit alleges Agreliant Genetics failed to obtain the plaintiff's consent for saving such information.

Maricle seeks trial by jury, liquidated damages, attorney fees and all other just and appropriate relief. He is represented by attorneys Brandon M. Wise and Paul A. Lesko of Peiffer Wolf Carr & Kane APLC in St. Louis.
