Customer alleges Walgreens sold flash drive without advertised memory

BELLEVILLE — A customer is suing Walgreens, alleging he was sold a flash drive that did not contain the memory it was advertised as having.

Brian O'Keefe, individually and on behalf of all others similarly situated, filed a class action complaint March 13 in St. Clair County Circuit Court against Walgreen and Boots Alliance Inc., alleging unfair and deceptive business practices, 

The suit states O'Keefe purchased a USB flash drive from a Walgreens store in Deerfield that was advertised as being 32 GB. However, the plaintiff alleges the defendant sold flash drives that contained less space than advertised. 

O'Keefe alleges the flash drive he purchased contained 29.8 GB instead of 32 GB. The defendant's 16 GB flash drive was allegedly only 14.9 GB in capacity and the 64 GB flash drive was allegedly only 59.6 GB in capacity. 

The plaintiff and other consumers who purchased the flash drives were economically harmed by the defendant's deceptive trade practices, the suit says.

O'Keefe seeks attorneys' fees, court costs, expenses and a trial by jury. The plaintiff is represented by attorneys Tiffany M. Yiatras of Consumer Protection Legal LLC in Ellisville, Mo., and by Francis J. "Casey" Flynn Jr. of Law Office of Francis J. Flynn Jr. in Los Angeles.
