Suit alleges man died from severed leg in train incident

EDWARDSVILLE  — A man is suing a railway company after his family member's leg was severed, resulting in his death. 

Tyler Dagon, as administrator of the estate of Timothy Dagon, deceased, filed a complaint March 5 in Madison County Circuit Court against BNSF Railway Company and U.S. Steel Corporation, alleging negligence, failure to offer safe services and wrongful death.

According to the complaint, when Timothy Dagon was in Granite City on March 5, 2017, working on a railcar owned and operated by BNSF Railway. The suit states Kevin Wylde, who was operating the railcar, failed to maintain control of the train and caused Dagon's leg to be severed.  As a result of his injuries, Timothy Dagan died later that month.

Tyler Dagon seeks damages of more than $50,000, plus court costs and all just and proper relief.  The plaintiff is represented by attorneys Roy C. Dripps, Charles Armbruster and Michael Blotevogel of Armbruster, Dripps, Winterscheidt & Blotevogel LLC in Maryville.
