Illinois Central school bus driver alleges towing company's employee dropped cigarette before collision

EDWARDSVILLE – A school bus driver is suing United Delivery and Recovery Co. and one of its drivers over a collision in Granite City that left her injured.

The suit states plaintiff Jennifer Tucker was operating a school bus heading east on Highway 162 near the intersection of East 23rd Street when a 2017 Dodge Ram tow truck owned by defendant United Delivery and Recovery Co. and driven by defendant Frank H. Smith collided with the bus.

The suit states Smith dropped a lit cigarette on the floorboard of the truck and tried to reach it instead of pulling off of the roadway, failed to keep his vehicle under control and failed to properly obey a traffic device.

Tucker alleges she suffered injury, disfigurement, lost wages, and other pain and suffering because of the accident. She is requesting payment for her costs of more than $50,000 as well as the cost of the suit.

The suit was filed Feb. 8 in the Madison County Circuit Court. Tucker is represented by Erin M. Phillips of Unsell, Schattnik & Phillips PC of Wood River.
