Troy homeowners allege neighbor damaged landscaping with herbicide

EDWARDSVILLE -- Troy homeowners have filed suit against a neighbor for spraying the herbicide Roundup and allegedly damaging the plaintiffs' landscaping. 

Virginia and Harold Rice and Jennifer and David Hopkins filed the lawsuit in Madison County Circuit Court against neighbor Joseph M. Mersinger. 

The plaintiffs allege neighbor Mersinger owns and operates farmland near their Troy homes and caused damages to their landscaping by spraying the herbicide Roundup. 

The suit states that while applying Roundup to his own Troy property, Mersinger trespassed and had a "degree of certainty" that the herbicide would intrude on his neighbors' land. 

The plaintiffs claim the herbicide drift led to costs for investigation, appraisal, removal, and replacement of damaged flora. 

The plaintiffs seek damages of more than $50,000, as well as the cost of court.
