Suit alleges motorist caused collision while distracted by phone

BELLEVILLE — A motorist is accused of causing a Marissa collision while negligently using her cell phone. 

Brenda S. Kinzel, Rickie L. Kinzel and Mary L. Schmierbach filed a complaint on Feb. 8 in the St. Clair County Circuit Court against Patsy Wilson, alleging she negligently used her cell phone while driving.

According to the complaint, the plaintiffs allege that on Oct. 31, 2018, Brenda Kinzel and Schmierbach were in a vehicle traveling northbound on North Main Street near its intersection with School View Drive in Marissa when Wilson allegedly caused a collision. 

The plaintiffs claim they sustained severe and permanent injuries to their bodies resulting in medical bills, loss of normal life, disability and disfigurement. Rickie Kinzel claims he has been deprived of the support and services of his spouse Brenda Kinzel. 

The plaintiffs allege Wilson negligently operated her vehicle while distracted, failed to maintain a careful lookout and failed to drive her vehicle in the correct lane on the roadway.

The plaintiffs request a trial by jury and seek judgment in their favor for a sum exceeding $50,000, plus costs of this action. They are represented by Brian M. Wendler, Angie Zinzilieta and Paul E.H. Rademacher of Wendler Law PC in Edwardsville.
