EDWARDSVILLE — A former Lebanon nursing home resident claims she was injured when she fell while under the defendant's care.

Kim Dusky filed a complaint Feb. 5 in St. Clair County Circuit Court against Petersen Health Group LLC, doing business as a Lebanon Care Center, alleging failure to provide care, services and assistance to maintain a patient's well-being.

According to the complaint, between Nov. 29, 2017 and Jan. 25, 2018, Dusky was a resident at Lebanon Care Center and was designated as a high-risk fall patient. She alleges Lebanon Care Center failed to employ and use bedrails and other appropriate restraints to prevent Dusky from falling and negligently allowed her to fall from her bed.

As a result, Dusky fell on Dec. 1, 2017, sustaining injuries to her face/lip, left leg and left hip, including her bones, ligaments and tendons.

Dusky seeks trial by jury, damages of more than $50,000, plus attorney fees, court costs and all further just and proper relief. She is represented by attorneys Stephen J, Telken and Adam W. Bragee of Walton Telken LLC in Edwardsville.
