Granite City homeowners claim excavator and engineer failed to properly install water drain line

EDWARDSVILLE — A Granite City couple is suing the city, as well as the engineering firm and contractor hired to install a water drain line near their property, claiming they failed to properly install and to backfill.

Ronald and Patricia Galbraith filed a complaint on Jan. 2 in the Madison County Circuit Court against the city, Juneau Associates and Kamadulski Excavating and Grading Co., alleging that they failed to properly monitor and inspect water lines during and after installation.

According to the complaint, the plaintiffs allege that on May 23, 2018, the plaintiffs' yard gave way and collapsed under Ronald Galbraith's weight. He sustained an injury to his left knee and was caused to suffer pain and suffering, mental anguish, loss of time to work and loss of normal life.

The plaintiffs hold the defendants responsible because they allegedly failed to properly connect the water lines to prevent erosion and washing away of backfilled soil and failed to respond to complaints regarding the erosion and collapsing of the backfilled soil.

The plaintiffs request a trial by jury and seek judgment in their favor in an amount greater than $50,000, plus costs. They are represented by Brian M. Wendler, Angie Zinzilieta and Paul Rademacher of Wendler Law PC in Edwardsville.
