Man sues after falling down steps at Madison property

EDWARDSVILLE — A man who claims he fell down a set of stairs when railing came loose from drywall is suing the owner of the Madison property where the incident occurred.

Robert Lee Galbraith III filed a complaint on Jan. 22 in the Madison County Circuit Court against Don Jones alleging that Jones failed to keep premises on Kennedy Drive in a reasonably safe condition.

According to the complaint,Galbraith alleges that on July 11, 2017, while going down the steps to Jones's basement, the stair rail suddenly detached from the dry wall causing him to fall to the bottom of the steps where he "smashed" into a steel door. He suffered serious and permanent injuries resulting in medical expenses and lost wages.

The plaintiff holds Jones responsible because he allegedly failed to provide a safe means of ingress/egress from the premises and failed to give adequate warning of the unsafe condition.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of more than $50,00, plus costs. He is represented by Randall P. Steele of Steele Law Offices LLC in Glen Carbon.
