Insurance company accuses motorist of negligence

EDWARDSVILLE — An insurer is suing a motorist for allegedly causing a collision and costing the plaintiff damages. 

Progressive Northern Insurance Company, a/s/o Liam Maher, filed a complaint on Jan. 22 in the Madison County Circuit Court against Robert Everage, alleging he breached his duty to exercise reasonable care to avoid a collision.

According to the complaint, the plaintiff alleges that on Aug. 2, 2017, Maher was struck by Everage's vehicle at the intersection of State Street and Patterson Place. As a result, Progressive became obligated to pay $105,000 for Maher's damages. 

The plaintiff holds Everage responsible because the defendant allegedly failed to operate his vehicle at a speed that was reasonable and proper, failed to maintain a careful lookout and failed to maintain his vehicle within a single lane.

The plaintiff requests a trial by jury and seeks judgment agains the defendant in the amount of $105,000, plus costs of this action. He is represented by Abbey Lerner of Deutschman & Skafish PC in Chicago.
