Former employee accuses used car dealership of retaliatory discharge

EDWARDSVILLE — A former employee is suing a used car dealership for allegedly terminating her for seeking Worker's Compensation benefits. 

Rosario James filed a complaint on Jan. 8 in the St. Clair County Circuit Court against D & D Motors Ltd., alleging the used car dealership violated the Age Discrimination in Employment Act and the Illinois Human Rights Act.

According to the complaint, the plaintiff alleges she was terminated from her employment immediately after suffering a work related injury. She also alleges she was terminated due to her age. 

She claims she suffered and will continue to suffer lost wages and fringe benefits, emotional distress, mental anguish, and inconvenience. 

The plaintiff alleges the defendant retaliated against her and terminated her employment for requesting Illinois Worker's Compensation benefits. 

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount greater than $50,000, plus costs and all other relief that is appropriate. She is represented by Michael J. Brunton and Mary M. Stewart of Brunton Law Office PC in Collinsville.
