BENTON — An insurance provider is suing a logistics company and other defendants for allegedly failing to notify the plaintiff about a collision.
Artisan and Truckers Casualty Co. filed a complaint Dec. 27 in U.S. District Court for the Southern District of Illinois against Neron Logistics LLC, et al, alleging failure to provide prompt notice of a vehicle crash that occurred April 9, 2014.
According to the complaint, Artisan and Truckers claims it received a call on July 2 from an attorney in regards to a collision that occurred on April 9, 2014 on Interstate Highway 70 in Madison County. The plaintiff alleges this is the first notice it received of the crash.
The plaintiff alleges the defendants failed to promptly report the collision and failed to provide the names and addresses of all persons, any witnesses and the license plate numbers of the vehicles involved in the crash.
Artisan and Truckers Casualty seeks trial by jury, declaration that the plaintiff owes no duty to defend, indemnify or provide surety to defendants and that it has no liability coverage under the policy. It is represented by attorney Thomas L. Buck of Magnani & Buck Ltd. in Chicago.
